These Terms of Use ("Terms") govern your access to and use of the MyGearSafe mobile application and website (together, the "Service"), provided by MyGearSafe ("MyGearSafe," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at Hello@mygearsafe.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
MyGearSafe lets you catalog your musical instruments and equipment, track estimated values, generate reports, and use related features, including AI-assisted identification, market-value lookups, price trends, offer advice, and social features such as profiles, walls, and friends.
Estimated values are informational only. Valuations, price trends, and offer advice are estimates generated from third-party data (including Reverb) and automated tools. They are not appraisals, financial advice, or guarantees of value, insurability, or sale price. You should independently verify any value before relying on it for insurance, sale, purchase, or financial decisions. MyGearSafe is not responsible for decisions you make based on this information.
You retain ownership of the content you submit, including gear details, photos, and profile information ("User Content"). By submitting User Content, you grant MyGearSafe a worldwide, non-exclusive, royalty-free license to host, store, process, display, and use it as needed to operate and improve the Service (for example, to process photos through AI features or to display your public profile to other users).
You are responsible for your User Content and represent that you have the rights to submit it and that it does not violate any law or third-party rights. You agree not to upload content that is illegal, infringing, harmful, or that you do not have permission to share.
If you make content public, other users may view it. You are responsible for what you choose to share publicly.

We may remove content or suspend accounts that violate these Terms.
MyGearSafe offers an optional paid subscription ("PRO") that unlocks additional features and removes ads. Subscriptions are offered on a monthly and/or annual basis, and may include other options.
Auto-renewal. Subscriptions are auto-renewing. Unless canceled, your subscription automatically renews at the end of each billing period, and your payment method is charged the then-current price for the next period.
Billing. Payment is charged to your Apple App Store, Google Play, or other designated payment account at confirmation of purchase. Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
Managing and canceling. You can manage or cancel your subscription, and turn off auto-renewal, through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
Free trials and promotions. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
Refunds. Purchases are generally handled by the applicable app store (Apple or Google), and refunds are subject to their policies. We do not control and are not responsible for app-store refund decisions.
Price changes. We may change subscription prices. We will provide notice of price changes as required, and changes apply to future billing periods.
By subscribing, you authorize these recurring charges. Subscription terms are also presented at the point of purchase, and those terms, together with the applicable app store's terms, apply to your purchase.
The Service relies on third-party providers (including Base44, Reverb, AI/large-language-model providers, RevenueCat, Apple, Google, Stripe, Resend, and Google AdMob). Your use of certain features may also be subject to those providers' terms. We are not responsible for third-party services, their content, or their availability.
The free version of the Service displays advertising. By using the free version, you agree to receive ads. Subscribing to PRO removes ads. See our Privacy Policy for how advertising data is handled.
The Service, including its software, design, and content (excluding User Content), is owned by MyGearSafe or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY VALUATIONS OR DATA WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYGEARSAFE AND ITS PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless MyGearSafe and its providers from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Certain provisions (including ownership, disclaimers, limitation of liability, and indemnification) survive termination.
These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in Ohio, unless otherwise required by applicable law.
We may update these Terms from time to time. We will post the updated version with a revised "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
